Free Tier & Fair Use Policy

1. Purpose, Status, and Scope

1.1 Purpose of the Free Tier

Beginso may make a Free Tier available so that individuals, professionals, businesses, organisations and teams can evaluate and use selected Platform functionality without payment. The Free Tier is intended for legitimate, reasonable and proportionate use of Beginso's form-creation, publishing, response-management, reporting, workspace and collaboration functionality.

1.2 Binding Status

This Policy is binding on every User accessing a Free Tier and supplements the Terms of Use, Privacy Policy, Acceptable Use Policy, Cookie Policy and any plan-specific terms published by Beginso. If there is a conflict concerning usage limits or Free Tier conduct, the more restrictive applicable provision will prevail to the extent permitted by law.

1.3 Who This Policy Covers

This Policy applies to Registered Users, Workspace Owners, administrators, Authorised Users, Team Members, trial users, beta users and any other person or organisation using a no-charge Beginso plan or promotional access. Respondents who merely complete a public Form without a Beginso Account are not Free Tier Users merely because the Form Owner is using a Free Tier Account.

2. Definitions

Capitalised terms not defined in this Policy have the meanings given in the Terms of Use and Privacy Policy.

• "Free Tier" means any plan, trial, beta, promotional, introductory or no-charge mode of access offered by Beginso.
• "Published Limits" means the then-current limits, quotas, feature availability, retention periods, usage thresholds, workspace limits, response limits, file limits or other plan conditions displayed on the Platform, pricing page, dashboard, plan page or other official Beginso documentation.
• "Excessive Use" means usage that materially exceeds the intended scope, technical capacity, normal usage profile or economic assumptions of the Free Tier, whether or not a specific numerical limit has already been exceeded.
• "Resource" includes Forms, responses, Submissions, uploaded files, storage, exports, reports, analytics, Workspaces, Team Members, invitations, notifications, API calls, processing capacity, bandwidth and any other Platform resource.

3. No Entitlement to Free Service

3.1 Discretionary Availability

The Free Tier is provided at Beginso's discretion as a limited-access offering. Except where Applicable Law requires otherwise, no User acquires a vested, perpetual or irrevocable right to continue receiving any free feature, quota, allowance, storage allocation, response capacity, Workspace capability or other Free Tier benefit.

3.2 Modification or Withdrawal

Beginso may introduce, modify, reduce, expand, suspend, replace or discontinue the Free Tier or any feature within it. Where reasonably practicable, Beginso may provide notice of material reductions affecting existing Registered Users. Emergency, security, legal, anti-abuse or infrastructure-related changes may take effect immediately.

3.3 No Compensation for Changes

To the maximum extent permitted by Applicable Law, modification or discontinuation of the Free Tier does not create an entitlement to compensation, credits, damages, substitute services or continued access to previously available no-charge features.

4. Free Tier Features and Published Limits

4.1 Limits Are Published Separately

Beginso may set and revise Free Tier limits from time to time. Specific numerical limits are not fixed by this Policy unless expressly stated by Beginso in writing. The applicable limits are those officially published or displayed for the relevant Account at the time of use.

4.2 Types of Limits

Free Tier limits may include, without limitation:

• number of active or total Forms
• number of responses or Submissions per Form, Account, Workspace or period
• uploaded-file size, number, type, storage or aggregate storage
• number of Workspaces, Team Members, invitations or shared Forms
• analytics depth, history or retention
• CSV or PDF export availability or frequency
• branding, customisation, templates, conditional logic or advanced features
• notification volume
• API access, automation, integration or rate limits, where such functionality is made available
• processing, bandwidth, security, support or other resource thresholds

4.3 Platform Display Controls

The Platform may enforce limits automatically. A User may be prevented from creating additional Forms, accepting additional Submissions, uploading additional files, inviting more Team Members, generating further reports or using a restricted feature once the applicable limit is reached.

5. Fair Use Framework

5.1 Fair and Proportionate Use

Free Tier use must remain reasonable, proportionate and consistent with the intended purpose of a no-charge SaaS plan. Beginso may assess overall usage based on volume, frequency, storage impact, processing load, traffic, response activity, automation, commercial intensity, security impact and the extent to which usage resembles sustained production-scale or enterprise use.

5.2 Fair Use Applies Even Below a Numerical Limit

Published numerical limits do not create a right to use the Platform in a manner that is abusive, technically harmful, commercially exploitative or inconsistent with the intended purpose of the Free Tier. Beginso may act where usage is excessive or abusive even if a published limit has not yet been exceeded.

5.3 Legitimate Professional Use

Incidental or reasonable professional and business use may be permitted on the Free Tier where consistent with the relevant plan. Sustained high-volume use, large-scale data collection, extensive team deployment, repeated high-volume exports, automated operation or usage better suited to a paid or enterprise plan may be restricted or require an upgrade.

6. Free Tier-Specific Prohibitions

In addition to all Prohibited Activities in the Acceptable Use Policy, Free Tier Users must not:

• create or maintain multiple Accounts, aliases, email identities, organisations or Workspaces for the purpose of bypassing a quota, suspension, restriction, feature limit or other plan condition
• use scripts, bots, automation or coordinated manual processes to mass-create Accounts, Forms, Workspaces, invitations or other Free Tier resources without written authorisation
• circumvent, manipulate, disable or interfere with technical controls used to enforce Free Tier limits
• use the Free Tier as infrastructure for sustained high-volume public data collection, mass lead harvesting, spam campaigns, credential harvesting, phishing, scraping or other abusive collection activity
• resell, sublicense, rent, white-label, commercially redistribute or provide Free Tier access as a managed service to third parties without Beginso's written authorisation
• artificially divide one organisation, project, campaign or dataset across multiple Free Tier Accounts to avoid an applicable limit
• use public Forms, embeds, QR codes or links in a manner that creates abnormal automated traffic, denial-of-service conditions or disproportionate infrastructure consumption
• manipulate response counts, analytics, reports, referrals, usage meters, plan eligibility or any other Platform measurement
• use the Free Tier in any manner prohibited by the Terms of Use, Acceptable Use Policy, Privacy Policy or Applicable Law

7. Sensitive, Regulated, and High-Risk Data

7.1 User Responsibility

A Free Tier User remains solely responsible for determining whether the Free Tier is appropriate for the nature and sensitivity of the information the User chooses to collect or process. The availability of file-upload fields, Forms or Workspaces does not constitute a representation by Beginso that the Free Tier is suitable for every regulated use case.

7.2 Additional Safeguards May Be Required

Health information, financial information, biometric information, children's data, government-issued identifiers, identity documents, regulated employment or education records, confidential corporate information and other specially protected information may require additional contractual, security, regulatory or organisational safeguards. Beginso may restrict or prohibit such processing on the Free Tier or require an enterprise arrangement, separate data processing agreement or additional safeguards.

7.3 No Sector-Specific Compliance Representation

Use of the Free Tier does not by itself represent or warrant that a User's particular workflow complies with any sector-specific legal, regulatory, accreditation, recordkeeping, cybersecurity or data-localisation requirement. The User is responsible for assessing and satisfying those obligations.

8. Responses, Files, Storage, and Retention

8.1 Plan-Based Availability

The number of responses, the period for which response history remains accessible, uploaded-file capacity, storage allocation, report history and other data-related limits may vary by plan and may be changed as described in this Policy.

8.2 No Permanent Storage Commitment

Unless Beginso expressly agrees otherwise in writing, the Free Tier is not offered as a permanent backup, archival or disaster-recovery service. Users should maintain independent copies of information that is important to their business, legal, regulatory or operational needs.

8.3 Exceeding a Limit

If a Free Tier User reaches or exceeds an applicable limit, Beginso may block additional submissions, uploads, invitations, exports or other activity; restrict access to affected functionality; request that the User delete or reduce data or activity; or require an upgrade before further usage is permitted.

8.4 Data Following Downgrade or Plan Change

Where an Account moves from a paid plan to a Free Tier, features or resources exceeding the Free Tier may become unavailable, read-only, restricted, queued for deletion or otherwise subject to the Free Tier rules after any grace period expressly offered by Beginso. Users are responsible for exporting or otherwise preserving important data before a downgrade takes effect.

9. Workspaces, Team Members, and Collaboration

9.1 Workspace Limits

Free Tier Workspaces may be subject to limits on the number of Workspaces, Team Members, invitations, shared Forms, roles, permissions or collaboration features available.

9.2 Organisational Circumvention

An organisation may not use multiple personal Accounts or multiple Free Workspaces to reproduce, substitute for or circumvent a paid organisational or enterprise plan where the usage is, in substance, one coordinated organisational deployment.

9.3 Administrator Responsibility

Workspace Owners and administrators remain responsible for Team Member access, permissions, invitations and the lawful use of information accessible through the Workspace, regardless of whether the Workspace is free or paid.

10. Automation, API, and High-Volume Use

10.1 Automated Use

Free Tier access is primarily intended for ordinary human use through Beginso's authorised interfaces unless Beginso expressly provides automation or API functionality for the relevant plan.

10.2 Rate Limiting and Protection

Beginso may apply rate limits, traffic controls, CAPTCHAs, bot detection, request throttling, concurrency limits and similar technical controls to protect Free Tier capacity and Platform integrity. Circumvention of such controls is prohibited.

10.3 API Access

Any API access, if introduced, may be subject to separate terms, credentials, quotas and plan eligibility. Free access to an API may be limited, modified or withdrawn independently of other Platform functionality.

11. Beta, Trial, and Promotional Access

11.1 Temporary Nature

Beta, trial, launch, promotional or introductory features may be temporary and may contain incomplete, experimental or changing functionality. Such access does not create a permanent entitlement to the feature, quota or commercial terms offered during the promotional period.

11.2 Transition After Promotion

At the end of a trial, beta or promotional period, Beginso may move the Account to the then-current Free Tier, require selection of a paid plan, disable affected functionality or otherwise apply the plan terms then in force.

11.3 Feedback

Where Users provide feedback regarding beta or trial functionality, Beginso may use that feedback to improve the Platform without restriction, provided that Beginso does not thereby acquire ownership of the User's Forms, Submissions or uploaded files.

12. Advertising, Promotions, and Referral Programmes

12.1 Future Programmes

Beginso may introduce advertising, sponsored placements, referral benefits, credits, promotional quotas or similar programmes for Free Tier Users. Any such programme may be governed by additional published terms.

12.2 Referral and Promotion Abuse

Fake referrals, self-referrals where prohibited, duplicate Accounts, bot-generated referrals, spam referrals, fabricated eligibility, manipulated promotional claims or any other attempt to obtain benefits dishonestly may result in reversal of benefits, Account restriction, suspension or termination.

12.3 No Guaranteed Promotional Value

Promotional credits, referral benefits, bonus limits and similar benefits have no cash value unless Beginso expressly states otherwise and may expire, be revoked for abuse or be discontinued in accordance with their applicable terms.

13. Monitoring and Fair Use Assessment

13.1 Usage Monitoring

Beginso may measure and analyse technical and usage information reasonably necessary to enforce plan limits, detect abuse, maintain security, allocate infrastructure, prevent fraud and assess compliance with this Policy, in accordance with the Privacy Policy.

13.2 Indicators of Excessive or Abusive Use

Indicators may include unusually high response volumes, excessive storage consumption, abnormal traffic, repeated Account creation, automated activity, disproportionate report generation, excessive file transfer or download activity, abnormal Workspace expansion, coordinated circumvention or usage patterns inconsistent with ordinary Free Tier use.

13.3 No Obligation to Disclose Thresholds

Beginso is not required to disclose confidential anti-abuse thresholds, internal fraud rules, security triggers, infrastructure thresholds or detection logic where disclosure could enable circumvention or undermine Platform security.

14. Enforcement

14.1 Available Actions

Where Beginso reasonably believes that a User has exceeded applicable limits, engaged in Excessive Use, circumvented plan restrictions or otherwise breached this Policy, Beginso may take one or more of the following actions, subject to Applicable Law:

• issue a warning or request remediation
• restrict creation of additional Forms, responses, uploads, exports, Workspaces, invitations or other resources
• throttle or rate-limit usage
• disable or limit specific features
• place affected resources in a read-only or restricted state
• require the User to reduce usage or remove excess data
• require an upgrade to continue the relevant level of usage
• suspend the Account, Workspace or affected functionality pending investigation
• reverse promotional or referral benefits obtained through abuse
• terminate the Account for material, repeated or deliberate violations

14.2 Immediate Action

Beginso may act without prior notice where reasonably necessary to address security threats, fraud, unlawful conduct, deliberate circumvention, material infrastructure risk, repeated abuse or any serious violation of the Acceptable Use Policy.

14.3 No Refund or Compensation

Because the Free Tier is provided without Fees, enforcement or limitation of Free Tier access does not ordinarily give rise to a refund or compensation claim, subject to mandatory rights under Applicable Law.

15. Appeals and Review

15.1 Request for Review

A User affected by a Free Tier enforcement action may request review by contacting support@beginso.com and providing the Account information, description of the action, relevant facts and supporting evidence.

15.2 Review Outcome

Beginso may restore access, maintain the restriction, modify the restriction, request further information, require remediation or take final action. Beginso will endeavour to handle good-faith appeals within a reasonable period. Nothing in this process limits mandatory rights available under Applicable Law.

16. Upgrades, Downgrades, and Future Plans

16.1 Upgrades

Beginso may offer paid, business, enterprise, add-on or other plans providing higher limits, additional features, extended history, enhanced collaboration, additional storage, priority support, integrations, administration or other functionality. The applicable paid-plan terms will be those published or agreed at the time of subscription.

16.2 Downgrades

After a downgrade, the Free Tier rules apply. Paid-plan-only features may become unavailable, excess resources may become restricted, and data exceeding the Free Tier may be subject to the treatment described in Section 8.4.

16.3 Future Plans

This Policy does not fix the detailed commercial terms of any future paid or enterprise plan. Beginso may introduce, rename, restructure, combine or discontinue plans in accordance with the Terms of Use and Applicable Law.

18. General Provisions

18.1 Relationship to Other Policies

This Policy must be read together with the Beginso Terms of Use, Privacy Policy, Acceptable Use Policy, Cookie Policy and any plan-specific or enterprise terms. Together, those documents form the applicable legal framework governing use of the Platform.

18.2 Amendments

Beginso may amend this Policy from time to time. The updated version will be published with a revised effective or last-updated date. Material changes may be notified through the Platform, email or another reasonable method where appropriate.

18.3 Severability

If any provision of this Policy is held invalid or unenforceable, it will be modified to the minimum extent necessary to make it valid and enforceable, or severed if modification is not possible, without affecting the remaining provisions.

18.4 Governing Law and Disputes

This Policy is governed by the laws of the Republic of India, subject to mandatory rights that cannot lawfully be excluded. Disputes are subject to the dispute-resolution provisions of the Beginso Terms of Use, including the arbitration framework and Mumbai, Maharashtra, India seat specified there.

18.5 No Waiver

Beginso's failure to enforce any provision on one occasion does not waive its right to enforce that provision or any other provision later.
